Bar Provides Insurance Resource

IN LIGHT OF THE new insurance disclosure rule, NHBA Executive Director Jeannine McCoy said it was a fortunate coincidence, not the result of the Bar acting on "inside information," that led to the creation last year of a subsidiary insurance agency exclusively for Bar members.

The NHBA Insurance Agency, Inc., staffed by Suzanne Morand, an experienced and licensed insurance professional, maintains relationships with several insurance carriers doing business in New Hampshire and is personally assisting Bar members in shopping and applying for professional liability insurance.

"The concept of the Bar directly providing insurance information and referral services to Bar members had been under development well before attorney Varney approached the Supreme Court Rules Committee with the idea of a mandatory disclosure provision," McCoy said. "We were responding to identified needs of Bar members for information and assistance in obtaining reliable insurance of all types - the professional liability coverage is simply the first opportunity in what we are hoping to offer as a menu of insurance options for members."

Due to national insurance trends and the state of the economy, professional liability insurance in some cases has become more difficult or expensive to obtain, McCoy and Morand acknowledge. However, unlike health insurance, just because a practitioner does not have insurance now does not mean that he or she will have an especially difficult time obtaining it. "The underwriting of professional liability insurance depends a great deal on an attorney or firm's area of practice and prior history," Morand said. On the other hand, attorneys with existing coverage should contact Morand several months before their policy expiration date because, in this "hard market," renewals are not automatic for all practitioners. "I encourage attorneys to attend to this issue as soon as possible - whether they are covered now or are uninsured," said Morand.
