Uniform Trust Code Project Formed to Draft, Promote UTC in NH

TRUST AND ESTATE lawyers, members of the judiciary and members of the banking community have organized the New Hampshire Uniform Trust Code Project to draft and promote the adoption of the Uniform Trust Code in New Hampshire. The UTC Project envisions the adoption of the UTC in New Hampshire during the next legislative session.
The UTC Project, chaired by Susan Leahy of Orr & Reno, P.A., commenced its work in January of this year. At that time, members met in Hartford, Conn., with David M. English, professor of law at the University of Missouri and the UTC reporter for the National Conference of Commissions on Uniform State Laws, and with Michele Clayton, legislative counsel for the NCCUSL. The meeting was hosted by the Connecticut Bar Association and included representatives of bar associations and probate judiciaries of a number of other New England states interested in the UTC.
The first phase of the New Hampshire UTC Project has divided the lawyer-members into nine subcommittees, with each subcommittee assuming drafting responsibility for one or more articles of the UTC.
Deliberations on provisions of the UTC will begin on Sept. 23 from noon to 4:00 p.m. at the Administrative Offices of the Courts, Hazen Drive, Concord and will continue on Oct. 17 from noon to 5 p.m. at Franklin Pierce Law Center. Professor English will join the group at its Oct. 17 meeting. Trust and estate lawyers, members of the judiciary and members of the banking community are invited to join the Project. Rep. Hunt is expected to sponsor the UTC legislation.
