Federal District Court Docket No Longer Includes Responsive Pleading Deadlines
IN THE U.S. District Court-District of NH’s prior case management system, the docket reflected responsive pleading "due dates," such as "Objection Due" on a specific date. It has been the policy of the court that these due dates were for court use only and were not to be relied upon as an accurate computation of the actual responsive pleading deadlines. In order to avoid any confusion on the issue, effective Nov. 3, 2003, these "due date" entries have been replaced by a "Follow Up" entry in our new case management system. We have also included a cautionary note on the ECF-PACER login screen to warn users against relying on the "Follow Up" date in computing their responsive pleading deadlines. Although counsel is ultimately responsible for determining filing deadlines, the court has posted information sheets and worksheets on its Web site to assist practitioners in computing those deadlines. For access to those documents, go to www.nhd.uscourts.gov, select "Case Processing" on the left navigation bar, click on "Filing Information" and select either "Time Computation Rules" or "Time Computation Worksheet."
We hope these measures will assist practitioners in computing responsive pleading deadlines and will alleviate the potential of inadvertently misleading the parties and counsel as to the due dates for filing responsive pleadings.
