NHMCLE Board Adopts Revised Regulations for Rule 53

ON JULY 1, THE 2005 NHMCLE reporting year began and new regulations took effect to guide lawyers and CLE providers. The revisions were the result of a study of Rule 53 and its regulations by the NHMCLE Decade Review Committee, which recently submitted its report to the Supreme Court. The report will be discussed in more depth in a future issue of Bar News. The regulations are available to review at NHMCLE SC Rule 53 Info.

For lawyers, the major change is the requirement to file Attorney Credit Applications within 30 days of course completion for CLE programs not approved in New Hampshire. It is recommended that lawyers inquire when registering whether the program sponsor has sought approval and indicate that he/she is seeking credit in New Hampshire. The application information will feed into other technological changes that will take effect in the current NHMCLE reporting year. Lawyers will be able to review their CLE attendance throughout the year on the NHBA Web site, and plans call for electronic filing in the summer of 2005.

Other items addressed in the revised regulations include a definition of the program topics that will be accredited for law practice management as well as for law-related courses. The initial late fee for those who miss the August 1 filing deadline was increased to $50.

The new regulations specify that CLE credit will not be granted for attendance at, or teaching of, law school courses. They clarify that credit may not be claimed for participation in the same course via different presentation methods in the same year and establish a penalty for failure to respond to the annual audit of lawyer Certificates of Compliance. They also clearly outline the two types of program sponsorship as well as the committees of the NHMCLE Board.
