Traditional Bar Exam Changing Format

Starting with this February's administration of the Bar exam, candidates for admission to the NH Bar will be taking the Multistate Performance Test, which consists of two 90-minute problems that require students to review a simulated legal matter and develop materials to address it. The MPT was developed 10 years ago and it is in use in more than 23 states, but this will be the first year it will be used in NH. The MPT will replace 6 of the 12 essay questions on the NH portion of the test. On the following day, candidates will take the Multistate Bar exam. The February 2005 New Hampshire Bar Examination will be administered on Feb. 22 and 23, 2005.

The three-hour morning session on Tuesday will consist of two 90-minute MPT questions. The MPT, which is developed by the National Conference of Bar Examiners (NCBE), is designed to evaluate an applicant's ability to use fundamental lawyering skills in a realistic situation. Each MPT question is designed to be answered in one and one-half hours. The members of the New Hampshire Board of Bar Examiners will grade answers to the MPT questions.

The three-hour afternoon session on Tuesday will consist of six essay questions prepared and graded by members of the Board of Bar Examiners. Each question is designed to be answered in one-half hour. The areas of law subject to testing on the essay portion of the examination are contracts, sales, agency, family law, business entities (partnerships, limited liability companies and corporations), trusts, wills and estates, federal income and estate and gift taxation, secured transactions, bankruptcy and creditors' rights, New Hampshire criminal procedure and the New Hampshire Constitution. Essay questions may not be confined to one subject, such as business entities or contracts, but may cover more than one subject.
