Rules of Civil Procedure: A Long Saga
1984 - The first of several Bar member surveys make a top priority the modernizing of NH's rules of civil procedure.
June 1994 - Proposed NH Rules of Civil Procedure, a product of 10 years of discussion and drafting, are published and sent to the court. This version was endorsed by the NHBA Board of Governors, and, subsequently, by the Court's Advisory Committee on Rules. Numerous written comments are received by the court.
March 15, 1995 - Supreme Court holds oral arguments on the adoption of the proposed NHRCP. Attorney Martin Gross, NHBA President Jack Crisp, President-Elect Bruce Felmly and Arpiar Saunders argue in favor of its adoption. Speaking in favor of retaining the existing rules are attorneys Donald Dufresne, David Nixon, and Michael Callahan.
May 23, 1995 - In a 4-1 decision, the Supreme Court declines to adopt the proposed rules.
January 2005 - The Advisory Committee on Rules is asked by the court to revisit the proposed NHRCP and to consider similar rules for criminal procedure in light of the need for greater consistency and accessibility.
