Professional Conduct Committee ~ Suspension

Desmarais-Gordon, Christine adv. Professional Conduct Committee
#00-N-125
SIX-MONTH SUSPENSION

The New Hampshire Supreme Court Professional Conduct Committee investigated the matter of Desmarais-Gordon, Christine advs. Professional Conduct Committee #00-N-125 and issued a Six-Month Suspension on January 21, 2005.

Christine Desmarais-Gordon represented Lynn Turgeon in a personal injury action stemming from a 1998 car accident. See Karen S. Dexter v. Lynn Turgeon, Hillsborough County Superior Court, Southern District (Docket #99-C-415). The Committee determined that the record supports findings by clear and convincing evidence, including the following:

  • Ms. Desmarais-Gordon instructed her staff to alter medical release forms;

  • Ms. Desmarais-Gordon made false statements to third persons by sending altered medical release forms and cover letters to medical providers;

Ms. Desmarais-Gordon violated Ms. Dexter's privacy rights by falsely representing that Ms. Dexter authorized the release of her records;

  • Ms. Desmarais-Gordon failed to make reasonable efforts to ensure that her staff's conduct was compatible with her professional obligations;

  • Ms. Desmarais-Gordon knowingly engaged in conduct involving dishonesty, fraud, deceit and misrepresentation.

The Committee found by clear and convincing evidence that Christine Desmarais-Gordon violated the following Rules of Professional Conduct: 4.1(a), 4.4, 5.3(b), 8.4(c), and 8.4(a).

The matter is public record, and the full suspension order is available for inspection at the New Hampshire Supreme Court Attorney Discipline Office, 4 Park Street, Suite 304, Concord, New Hampshire 03301.
