Bar News - August 12, 2005

Thirty New Members Admitted by Motion

Eligible lawyers admitted to the bar in another state, territory or the District of Columbia, may apply for admission by motion to the New Hampshire Bar without examination.  Thirty such attorneys were sworn in on July 12, 2005 at the Supreme Court in Concord.

      Of the new members:

  25 are men;

  5 are women;

  29 are employed by law firms or other organizations, 7 in New Hampshire and 22 in other states;

  1 works at the U.S. Attorney’s office; 2 are solo practitioners; and 1 is not currently practicing;

  18 are 40 years of age or younger.

The requirements for admission by motion are set forth in Supreme Court Rule 42.  The provisions of Rule 42, including the Petition and Questionnaire for Admission to the Bar of New Hampshire and the fees involved, can be found on the Bar’s Web site, www.nhbar.org, by clicking on the Supreme Court’s legal link.  Any applicant for admission by motion should also consult the list of reciprocal jurisdictions.

There are special provisions relating only to lawyers admitted in Vermont or Maine.  A lawyer seeking admission by these provisions must complete 15 hours of continuing legal education on New Hampshire practice and procedure before filing a motion for admission.

Applicants seeking admission by motion are cautioned that the process of review by the Committee on Character and Fitness and the Supreme Court may be lengthy.  In addition, all applicants to the NH Bar must successfully complete the Multistate Professional Responsibility Examination (MPRE), including those applicants for admission by motion.  In fact, the MPRE must be completed before filing a motion for admission.

 All newly admitted attorneys are required to attend a Practical Skills Course given by the New Hampshire Bar Association within two years of admission to the bar. The availability of the Practical Skills CLE may also be found on the Bar’s Web site.
