Board of Governors Supports Legal Services Campaign

At its regular monthly meeting held Aug. 18, 2005, the NHBA Board of Governors took the following actions or reviewed these issues:

 

·         ABA House of Delegates review of governance. NHBA Delegate L. Jonathan Ross reported to the Board on the ABA House of Delegates’ review of proposals that would have resulted in changes that would have limited the role and influence of state bar association delegates in the direction of the ABA. The measures did not pass.

 

·         Financial statement review. The Board received the Association’s Financial Statements through May 2005. Treasurer Rob Howard noted that the format, which compares the current and prior year results, is easy to read and shows the Association in a comfortable end-of-the-year financial position.  The annual audit of the Association will be presented to the Board Committee on Administration of the Bar for review and recommendation to the full Board at its Sept. 15 meeting.  

 

·         Ethics Committee Opinion. The Board received the NHBA Ethics Committee’s Opinion #2004-05/1 – Non-Recourse Lawsuit Financing, in advance of its publication in Bar News. The opinion is published on page 12 of this issue.

 

·         Legal Services Campaign Agreement. Concluding a review that took place over the past several months of a document setting forth responsibilities among the various organizations involved, the NHBA Board of Governors approved the Joint Fundraising Agreement of the Campaign for Legal Services on the condition that the Pro Bono Board provides its approval. (NHBA Governor-at-Large Marilyn McNamara abstained.) Later in the meeting, John Funk, the Campaign Co-Chair (with Emily Rice) provided the Board with an overview of the three legal service organizations that receive funds from the campaign (Pro Bono, NH Legal Assistance (NHLA) and the Legal Advice and Referral Center (LARC)) and the history of funding over the years. The annual campaign’s goal for year one (which ends Dec. 2005) is $250,000 and for calendar year 2006 the campaign goal is $400,000 - $500,000.

 

·         NHBA Survey Work Group. NHBA Executive Director Jeannine McCoy will be working with Vice President Eleanor Dahar and a small group of interested Board members to do further analysis of the NHBA Member Survey Series results and formulate follow-up actions.

 

·         Bill Proposing Revocation of the NHBA Charter. President-elect Richard McNamara reported on the June 30th Committee hearing on HB 541 that proposes revocation of the NHBA Charter.  Rich McNamara sent a letter to Rep. Robert Mead providing information in response to the complex issues raised at that hearing. The Bar officers and executive director will continue to be responsive to the legislature in its review of this issue.

 

·         Fall Conference Planning. President Uchida reported that invitations to the Sept. 23-24 Fall Leadership Conference at the Mountain Club on Loon have been mailed. He encouraged Board members to attend this important event as it examines the future of the legal profession in New Hampshire and how it will apply to the future of this Association.

 

·         Court Meetings.  President Uchida reported that the Supreme Court has issued an invitation for the full Board of Governors to meet with the Court on Wednesday, Sept. 28 at 1:30 p.m.

 

·         Outreach Efforts. President-elect McNamara is exploring how best to reach out to the NH congressional delegation in Washington. President Uchida reported that he has set up meetings for the officers with Governor Lynch in September; and in upcoming months, with the NH Women’s Bar Association and the NH Trial Lawyers in October.

 

·         Family Division Concerns. Sullivan County Governor Lisa Wellman-Ally reported that the every-other-month judge in Sullivan and Coos counties is placing a truly unfair economic burden on the two poorest counties in the state.  In essence, access is being denied monthly to one county in NH. Jeannine McCoy will make sure that both Lisa and Keith Clouatre, Coos County Governor, are invited to the next Superior Court Bench/Bar meeting to bring this matter up for discussion. 

 

·         Medical Malpractice Panel Volunteer Solicitation. Director for Legal Services Ginny Martin, explained that SB 214 establishes screening panels with the statute requiring the Chief Justice of the Superior Court to maintain a list of qualified retired judges to serve as chairpersons for the panels and to maintain a list of attorneys and physicians who are willing to serve on the panels. The Bar will circulate a solicitation for members interested in serving on such panels. (See page 32.)

 

The Board also met in executive session to review the nominations of Edward M. Gordon as Franklin District Court justice, and Mark Weaver for special justice in the Exeter-Hampton District Court.
