US District Court – NH: ECF TIP: Pleadings Filed Electronically Must Include a Certificate of Service
Pursuant to Fed. R. Civ. P. 5(d) and LR 5.1(d), all documents filed using the ECF system must still include a certificate of service. The certificate of service must identify the manner and date on which service on each party was accomplished and should be included on the final page of the pleading being submitted.
Since the court began accepting electronic pleadings, however, a number of attorneys are filing pleadings without including a certificate of service. Other attorneys are filing the certificate of service as a separate document or attachment to a pleading. Remember, the proper practice in this district is the same as it was prior to electronic filing; the certificate of service should be included on the final page of the pleading being submitted. A sample Certificate of Service, which is taken from pages 60-61 of the District’s ECF User Manual, is set forth below:
