Notice of Amendment to Internal Operating Procedure VIII(E)
Request for Comments and Notice of Amendment
Pursuant to 28 U.S.C. § 2071(e), the court has determined that there is an immediate need to amend Internal Operating Procedure VIII(E) to eliminate the inconsistency between the $20 fee listed for a disk copy of a recording of an oral argument and the $26 fee prescribed by the Judicial Conference of the United States effective January 1, 2005.
Fees prescribed by the Judicial Conference are controlling and are set forth in the Schedule of Fees posted on this court’s website at www.ca1.uscourts.gov. The proposed amendment cross-references the Schedule of Fees to avoid the need to amend the internal operating procedure every time the Schedule of Fees changes.
These amendments are effective immediately. The court hereby invites public comments on these amendments. Comments should be submitted by October 17, 2005, and addressed to:

E. Recording. Oral arguments in all cases are digitally recorded for the use of the Court and are not part of the permanent record of the case. A disk copy of the recording of an oral argument may be obtained by submitting a request in writing to the Clerk with a check for $20.00 in the amount prescribed by the Judicial Conference of the United States. The Schedule of Fees is posted on this court’s website at www.ca1.uscourts.gov.
