Bankruptcy Filings Dry Up After New Law Takes Effect
Since the Bankruptcy Abuse Prevention & Consumer Protection Act of 2005 took effect Oct. 17, filings have dropped dramatically in New Hampshire.
In the two weeks before the new law went into effect, 1,700 NH residents filed for bankruptcy protection, and only 28 filed in the two weeks after. In that same period last year, 73 cases were filed. The rush to file before the Oct. 17 deadline demonstrated the apprehension that the changes caused citizens not only in New Hampshire, but across the nation.
Of the 28 filings in NH, only 6 were chapter 7; 20 were chapter 13 and 2 were chapter 11. Of the nearly 1,700 filings in the two weeks before Oct. 17, 1,654 were for Chapter 7 and only 128 for Chapter 13.
