First Circuit Court of Appeals to Sit in NH

NH ATTORNEYS WILL have the rare opportunity to see the US First Circuit Court of Appeals in action when a panel of three judges from that court sits in NH on October 3. The First Circuit will hear oral arguments on NH cases at the Warren B. Rudman Federal Courthouse in Concord.

The First Circuit encompasses the federal courts of Maine, Massachusetts, New Hampshire, Puerto Rico and Rhode Island.

The last time the First Circuit heard cases in NH was in 1997, shortly after the opening of the Warren B. Rudman Courthouse, according to James R. Starr, clerk of the U.S. District Court, District of NH. The First Circuit will again be sitting in that courthouse, in a ceremonial courtroom, when its panel of judges comes to NH next month.

The First Circuit normally sits in the John Joseph Moakley United States Courthouse in Boston. According to Barbara Rabinovitz, public affairs officer for the federal courts of the First Circuit, the court sits twice a year in Puerto Rico, one of its busiest districts, and visits the other districts less regularly. She said the judges’ hearing cases in NH will "give attorneys of that particular district the chance to see the court close up, without having to travel to Boston."

As it normally operates, a panel of three of its judges, rather than the full court, will hear oral arguments, Rabinovitz said.

The list of cases to be heard during the NH session of the First Circuit Court of Appeals will be available Sept. 19.

A reception is scheduled to follow the court’s NH session. Details will appear in the next issue of Bar News.
