Department of Safety Prosecution Update
By: Robert B. Gainor
The Department of Safety Prosecution Unit provides prosecution assistance to the State Police, Highway Patrol and Enforcement, State Fire Marshal, Marine Patrol and State Hospital Campus Police. The Prosecution Unit’s mission is to provide highly competent and professional prosecution services for Department of Safety law enforcement.
The Chief Prosecutor supervises attorneys, support staff and also appears in court. To streamline prosecution and provide improved representation of law enforcement, the prosecutors have been decentralized to three satellite locations. The defense bar and members of the public will have to know which attorneys are prosecuting their cases, or whether the arresting law enforcement agency is conducting the prosecution.
The Prosecution Unit provides primary and secondary court coverage throughout the state. Primary courts prosecute only misdemeanors—except for the Manchester District Court, where all violations and misdemeanors are prosecuted. For secondary courts, the law enforcement officers are primarily responsible for prosecuting all of their own cases (misdemeanors and violations). For these courts, parties should contact the arresting officer. Following are the primary courts along with contact information:
- Portsmouth; Exeter; and the Auburn District Court: Attorney Diane Dubay, Prosecution Unit, 315 Calef Highway, Route 125, Epping, NH 03042 (603) 679-3399
- Dover; Hampton; and the Rochester District Court: Attorney Jean Reed, Prosecution Unit, 315 Calef Highway, Route 125, Epping, NH (603) 679-3399.
- Merrimack and Manchester District Court: Patricia O’Brien, Prosecution Unit, 33 Hazen Drive, Concord, New Hampshire 03305. (603) 271-8421.
- Salem, Derry and Nashua District Court: Attorney Roni Andrew, Prosecution Unit, 4 Meadowbrook Road, Milford, NH 03055 NH (603) 672-3333.
- Concord, Hooksett and the Franklin District Court: Attorney Amy Klingler, Prosecution Unit, 139 Iron Works Road, Concord, NH 03301 (603) 271-4849.
For all other district courts, for both misdemeanors and violations, contact the arresting Department of Safety law enforcement officer.
Robert B. Gainor is Chief Prosecutor for the NH Department of Safety. He has been a member of the NH Bar since 1990.
