Attorney-Conducted Voir Dire Coming to Superior Courts
STARTING IN JANUARY 2002, attorneys trying civil cases in superior court in Rockingham or Cheshire counties will have the opportunity to question jurors to identify potential biases before selecting juries. The pilot project, authorized by HB 588, will continue for two years in courts in those two counties.
In addition to allowing attorneys to conduct voir dire, the new law also calls for enhanced instructions for juries by the court.
The New Hampshire Trial Lawyers Association will be conducting an all-day CLE program, Voir Dire 101, on Friday, October 26, to explore the concept and introduce techniques for effective use of voir dire. The faculty includes Elizabeth Foley, of the Chicago law firm Zagnoli McEvoy Foley, who specializes in assisting attorneys with pre-trial preparation, including the use of focus groups and composition and delivery of opening and closing statements; and Murray Ogburn, of Ogburn, Summerlin & Ogburn, a trial lawyer in Colorado and Nebraska who lectures internationally on trial advocacy and persuasion in the courtroom.
