Supreme Court Seeks Ethics Code Comments
On April 6, 2007, the NH Supreme Court issued an order seeking comments by June 1 on a comprehensive revision of the NH Rules of Professional Conduct.
RPC changes affect nearly all areas of practice, and Bar members are encouraged to review them carefully, as the Supreme Court’s June 1 deadline may be the last opportunity for comment before their adoption.
The revised ethics code is contained in a 159-page PDF available at the Court’s Web site at www.courts.state.nh.us/index.htm. That link, along with other information on the rules changes, is found in the Ethics materials area in Legal Links at www.nhbar.org. Included on that page is a link to an online CLE from last summer where several key rule changes were discussed by the proposal’s drafters.
The ethics code revisions were developed over the past five years by the NHBA Ethics Committee, which reviewed the RPC at the request of the Court’s Rules Advisory Committee. The Ethics Committee considered changes made to the ABA’s Model Rules of Professional Conduct and made corresponding changes where appropriate, and added or revised several NH-specific rules.
This proposal represents the first overhaul of the RPC since 1986 when a committee chaired by former NHBA President Stephen Tober redrafted the ethics rules.
