NH Attorneys Help Promote Advance Care Directives

THE NEW HAMPSHIRE Bar Association participated in efforts this year to encourage individuals to develop health care powers of attorney and living wills and to communicate their wishes regarding health care preferences to their loved ones.

John S. Kitchen, a Laconia elder law attorney and a member of the NH Bar Board of Governors, participated in a press conference conducted by the NH Medical Society to announce Gov. Jeanne Shaheen’s proclamation of Nov. 23, 2001 as "Annual Advance Care Planning Day" in New Hampshire. Kitchen is one of several elder or health care attorneys who have participated in training sessions to help health care personnel and other caregivers discuss advance care directives with patients and their families.

The designation of Advance Care Planning Day coincides with the publication by the NH-based Foundation for Healthy Communities of an Advance Care Planning Guide that includes revised living will and health care power of attorney forms. Mitchell Simon, a Franklin Pierce Law Center faculty member and expert on medical ethics, collaborated on the revision. The new advance care directive forms are available as downloadable word-processing documents at www.healthynh.com.

As a follow-up to Advance Care Planning Day, members of the Bar’s Elder Law, Probate and Estate Planning Section and staff members from the Lawyer Referral Service are conducting an Estate Planning LawLine on Wednesday, November 28 from 6:30 to 8:30 p.m.

The Bar’s Web site also has a public information booklet called "Wills, Trusts, and Advance Directives for Health Care and Financial Planning" available under "Public Information Pamphlets" in the "For the Public" section of the site as a downloadable PDF document.
