Revised Probate Form for Small Estates
Effective Jan. 2, 2002
THE PROBATE COURT has released the revised form listed below. It should be used immediately to comply with revisions to RSA 553:31 regarding Administration of Small Estates. It will also be available on the court’s Web site (www.state.nh.us/courts) within 30 days. Petition for Small Estate Administration (AOC-148-003 01/02). A change in the statute now requires filing a petition rather than an affidavit for small estate administration (aka voluntary administration) to begin a new case. Therefore, the title has been changed not only to include the petition terminology, but it now uses the language of the statute "Administration of Small Estates," since it is more descriptive than the term "voluntary administration" previously used. In the heading section of the form, there is now a place to check off if the petition is original or amended. Questions 1-7 are in the basic format used on all newer probate forms. RSA 553:31, III has also been changed to specify that if an amended petition is required, the total value of the personal estate reported on the original petition may be listed as one item. There is now a space for that right before the total line.
