John Pendleton Named Kirby Award Winner

THE NH BAR Foundation has announced that it will present its annual Robert E. Kirby Award, given to an attorney 35 years old or younger in recognition of his professionalism and civility, to attorney John T. Pendleton of the Nashua law firm Gottesman & Hollis.

Pendleton will receive the award at the Bar Foundation's 25th Anniversary Celebration dinner, to be held in conjunction with the 30th Anniversary Celebration of NHLA, on June 12 at C.R. Sparks in Bedford (see details).

The Kirby Award was established by the NHBF in 1996 in honor of attorney Bob Kirby, a young lawyer "of great skill, civility and good humor" who died in 1996 at the age of 35. Kirby was an attorney with the Concord law firm Gallagher, Callahan & Gartrell.

The winner of the Kirby Award - who is chosen by a committee of judges from the U.S. District and NH Supreme, Superior, probate and district courts - is an attorney 35 years old or younger who demonstrates the traits of civility, courtesy, perspective and excellent advocacy "that are the inevitable characteristics of our best lawyers."

The identity of the Kirby Award winner was traditionally kept secret until the Foundation's annual dinner; this year marks the first time that the winner is being announced before the dinner.

Pendleton, 35, earned his law degree from the University of Richmond in 1993 and was admitted to the NH Bar the same year. He was also admitted to the Maryland Bar in 1994 and to the Mass. Bar in 1996. He served on the NHBA Board of Governors as a governor representing Merrimack County from 1999-2000 and was recently elected as governor for Hillsborough County-South. He has served on the Bar's Ethics Committee since 1998 and served on the Legal Services Committee from 1997-98. He is a member of the NH Trial Lawyers Association, NH Association of Criminal Defense Lawyers, Association of Trial Lawyers of America and the William F. Batchelder Inn of Court. He also serves as a director of Rape and Assault Services of Nashua.

Bjorn R. Lange, the assistant federal public defender at the Federal Defender Branch Office, nominated Pendleton for the Kirby Award. Both are members of the Criminal Justice Act panel, a group of attorneys on the U.S. District Court list who take court-appointed cases representing indigent defendants in criminal cases. Pendleton and Lange have represented co-defendants in several cases and Lange said he is "consistently impressed with [Pendleton's] tact and grace in dealing with court staff, other lawyers and his clients."

"Of the lawyers I practice regularly with, John is the one who best meets the standards for the Kirby Award. He is remarkably civil, competent and unflappable," said Lange.

"He provides competent, effective representation without unnecessary hostility and abrasiveness. He is a good lawyer and a good person," he said.

Pendleton said he was "honored" to be named this year's Kirby Award recipient, because of whom the award is named after and what it represents.

"The ultimate goal is to be an effective but professional attorney, that is what this award is based on," Pendleton said. "I am humbled to receive the award and very excited by it."
