NH Supreme Court Orders
In accordance with Rule 39(2)(a)(2), the Supreme Court appoints Michael Scanlon, deputy clerk of Hillsborough County Superior Court Southern District, to serve as the alternate clerk member of the Committee on Judicial Conduct, replacing John Clark, clerk of Hampton District Court, who has retired. Deputy Clerk Scanlon is appointed to fill the remainder of a three-year term expiring on July 1, 2012.

Attorney Frederick J. Coolbroth, who currently serves as chair of the Board of Bar Examiners, has asked to be replaced as chair after completion of the July 2010 bar examination, but to remain a member of the board. The court grants this request and designates Attorney Gordon J. MacDonald to serve as chair of the Board of Bar Examiners effective November 1, 2010.

LD-2010-0004 In the Matter of Gary H. Reiner On March 11, 2010, the Attorney Discipline Office (ADO) filed a certified copy of the judgment of the United States District Court for the District of Maine. The judgment states that Attorney Gary H. Reiner was convicted of four criminal offenses; to wit, conspiracy to violate the Mann and Travel Acts; Interstate Travel to Facilitate an Unlawful Activiity; Inducing Travel to Engage in Prostitution; and Conspiracy to Launder Money. A certified copy of a mandate of the United States Court of Appeals for the First Circuit reflects that Attorney Reiner’s convictions were affirmed on appeal.
In accordance with Rule 37(9)(d), the court issued an order requiring Attorney Reiner to show cause why he should not be disbarred as a result of the convictions. Attorney Reiner filed a response in which he asked to be permitted to resign from the bar. Attorney Reiner then submitted an affidavit of resignation to the Professional Conduct Committee (PCC) in accordance with Rule 42(11). The PCC reviewed Attorney Reiner’s request to resign and recommended that it be denied due to the gravity of his conduct. The PCC’s recommendation is accepted. Attorney Reiner’s request to resign from the bar is denied.
After reviewing Attorney Reiner’s response to the court’s order, the court finds and rules that Attorney Reiner has failed to show cause why he should not be disbarred.
THEREFORE, in accordance with Rule 37(9)(d), the court orders that Gary H. Reiner be disbarred from the practice of law in New Hampshire. Attorney Reiner is hereby assessed all expenses incurred by the Professional Conduct Committee in the investigation and prosecution of this matter.

In accordance with Supreme Court Rule 37(3)(d), the Supreme Court appoints Lawrence A. Vogelman, Vice President of the New Hampshire Bar Association, to serve as the Board of Governors’ Representative on the Professional Conduct Committee, for a term commencing August 1, 2010, and expiring on August 1, 2011.
