NH Superior Court Order
ADMINISTRATIVE ORDER NUMBER 2010-40 Pursuant to authority conferred by Supreme Court Rule 54(5)(c), the following Administrative Order is issued:
Commencing on October 1, 2010, any Sentence Review Division or Habeas Corpus proceeding involving an inmate housed at the Northern New Hampshire Correctional Facility in Berlin will be conducted using video conferencing means so that the inmate will not need to be transported to the New Hampshire State Prison in Concord.
As a condition of conducting hearings using video conferencing in the above cases, the Department of Corrections must provide the capability for private, confidential telephone communication between the inmate and his counsel immediately prior to, during and immediately following the hearing.
This Order does not preclude the Sentence Review Division or the presiding justice in any Habeas Corpus proceeding from ordering the personal attendance of the inmate in any particular case if there is good reason to do so.
This Order is being entered on an experimental basis. It will be reviewed after one year to determine whether this Order should be made permanent.
