First Circuit Court of Appeals Proposes Local Rules Changes
THE UNITED STATES Court of Appeals for the First Circuit is proposing changes to Local Rules 46.5(d) and 46.6, which are part of the court's plan under the Criminal Justice Act for representation on appeal. The proposed amended rules can be found at the court's Web site at www.ca1.uscourts.gov.
The proposed changes to Local Rule 46.5 (d) are being proposed to conform the rule more closely to present court practice.
The proposed amendments to Local Rule 46.6 aim to clarify counsel's responsibility to continue to represent a defendant on appeal until relieved by the court, and to better explain the procedure and steps counsel should follow when moving to withdraw from representing a defendant in a criminal case.
The First Circuit Court of Appeals invites public comment on these proposed amendments. Comments should be submitted by Nov. 1, 2002, and addressed to:
