NHMCLE Issues Regulations for Admission on Motion
Applies Only to Newer Vermont Attorneys
THE NH MINIMUM Continuing Legal Education Board has approved a regulation to govern the approval of courses to meet the 15 hours of NH-related CLE required under a special provision of the new admission-by-motion rule. The provision applies only to lawyers admitted in Vermont who have three to five years of experience. (Under a special agreement with Vermont that is likely to be later extended to attorneys from Maine, there is a provision that lowers the experience standard from five years to three years for admission by motion.) To take advantage of that provision, attorneys must complete 15 hours of CLE on New Hampshire practice. The following regulations, effective March 1, indicate that NHMCLE Annual Sponsors will be certifying their courses that will meet the NH practice and procedure requirement. Attorneys may also apply for credit for courses they attend that are not presented by Annual Sponsors using the Attorney Credit Application Form found at - Continuing Legal Education / NHMCLE Information.
Note: Attorneys seeking admission by motion who meet the general experience standard of at least five years of current experience are not required to meet this 15-hour requirement; however, they will be required to take the Practical Skills program offered by the New Hampshire Bar Association. Regulation 53.3 Activities Qualifying for NHMCLE Credit
A. Methods of Complying with Rule

Applicants for admission on motion pursuant to Supreme Court Rule 42(11) or 42(12) may apply for approval of courses satisfying the requirement of continuing legal education on New Hampshire practice and procedure. Any courses otherwise qualifying for NHMCLE credit that are New Hampshire specific or that are directly relevant and applicable to the practice of law in New Hampshire will be considered for approval. Courses which are certified by NHMCLE Annual Sponsors as fulfilling the requirements of Supreme Court Rule 42(11) [Vermont] and 42(12) [Maine] will be treated as approved automatically. A minimum of 6 hours of the Supreme Court Rule 42(11)(g) and Rule 42(12)(h) requirement must be met by attending live presentations of approved courses (other than in-office courses) as a student.

Lawyers seeking to be admitted to practice in New Hampshire on motion pursuant to Supreme Court Rule 42(11) [Vermont] and 42(12) [Maine] must obtain a Certificate of Completion of approved courses in New Hampshire practice and procedure. The Certificate of Completion shall be filed with the applicant's Motion for Admission.
