High Court Rulings Back Arbitration; Rule 170 Updates

Attorney Edward Shumaker, of the Bernstein Shur law office in Manchester, says the US Supreme Court has in the past five years increasingly embraced the use of arbitration to settle disputes.

In an article on page 20, Shumaker looks at past cases and considers upcoming cases that challenge arbitration clauses or the validity of arbitrators’ decisions.

On page 22, the Judicial Branch’s new Office of Mediation & Arbitration (OMA) provides an update on signups for attorneys to serve on the paid and volunteer Rule 170 panels, and upcoming dates for refresher training or the certification training.

At presstime…the judges of the Superior Court submitted to the NH Supreme Court Advisory Committee on Rules a letter unanimously recommending that the new Rule 170 ADR program not be made permanent, but remain as a temporary rule for at least another year.
