Supreme Court Orders

In the Matter of Dianne E. Yacovone, Esq.

Dianne E. Yacovone was admitted to the New Hampshire bar on November 3, 2009. In accordance with Rule 42(7)(a), Attorney Yacovone was required to complete the Practical Skills course within two years of admission. The New Hampshire Bar Association reported to the court that Attorney Yacovone did not take the Practical Skills course as required. On November 3, 2011, this court issued an order requiring Attorney Dianne E. Yacovone to show cause why she should not be suspended from the practice of law in New Hampshire for failure to attend a practical skills course within two years of the date of her admission to the bar. Attorney Yacovone did not respond to the show cause order.

In accordance with Rule 42(7)(a), Attorney Dianne E. Yacovone is hereby suspended from the practice of law in New Hampshire. The court hereby requires that respondent’s trust accounts and other financial records be audited at respondent’s expense.

Attorney Yacovone is ordered to notify her clients in writing that she has been suspended from the practice of law in New Hampshire and to notify the Attorney Discipline Office by Friday, April 13, 2012, that she has completed this task. On or before Monday, April 23, 2012, the Attorney Discipline Office shall advise the court if it believes that an attorney should be appointed to make an inventory of Attorney Yacovone’s files and to take action to protect the interests of Attorney Yacovone’s clients.

Dalianis, C.J., and Hicks, Conboy and Lynn, JJ., concurred.

In the Matter of Richard L. Boire , Esq.

On November 7, 2011, this court issued an order, in accordance with Rule 50-A(2), for Attorney Richard L. Boire to file his 2011 trust accounting certificate and pay the fee of $300 for late filing of the certificate, or be suspended from the practice of law in New Hampshire. Attorney Boire has neither responded to the order, nor brought himself into compliance with Supreme Court Rule 50-A(2).

Attorney Richard L. Boire is hereby suspended from the practice of law in New Hampshire. The court hereby requires that Attorney Boire’s trust accounts and other financial records be audited at his expense.

Attorney Boire is ordered to notify his clients in writing that he has been suspended from the practice of law in New Hampshire and to notify the Attorney Discipline Office by Friday, April 13, 2012, that he has completed this task. On or before Monday, April 23, 2012, the Attorney Discipline Office shall advise the court if it believes that an attorney should be appointed to make an inventory of Attorney Boire’s files and to take action to protect the interests of his clients.

Dalianis, C.J., and Hicks, Conboy and Lynn, JJ., concurred.

In the Matter of Carrie Folsom , Esq.

On November 23, 2010, this court issued an order, in accordance with Rule 50-A(2), for Attorney Carrie Folsom to file her 2011 trust accounting certificate and pay the fee of $300 for late filing of the certificate, or be suspended from the practice of law in New Hampshire. Attorney Folsom has neither responded to the order, nor brought herself into compliance with Supreme Court Rule 50-A(2).

Attorney Carrie Folsom is hereby suspended from the practice of law in New Hampshire. The court hereby requires that Attorney Folsom’s trust accounts and other financial records be audited at her expense.

Attorney Folsom is ordered to notify her clients in writing that she has been suspended from the practice of law in New Hampshire and to notify the Attorney Discipline Office by Friday, April 13, 2012, that she has completed this task. The chief justice, pursuant to RSA 494:1, IX, appoints retired Supreme Court Justice James E. Duggan, a member of the New Hampshire Bar Association, to the Judicial Council, to serve a three-year term commencing immediately and expiring on December 31, 2014. Justice Duggan is appointed to replace David Garfunkel, who was appointed to the superior court.
