In the Matter of Alysia M. Proko, Esquire

The Supreme Court’s order dated April 11, 2013, which suspended Attorney Alysia M. Proko for failing to complete the Practical Skills course, is vacated.

On March 15, 2013, this court issued an order requiring Attorney Alysia M. Proko to file her certificate of compliance with the minimum legal education requirements for the reporting year ending June 30, 2012, and to pay the late fees assessed, or be suspended from the practice of law in New Hampshire.

Attorney Alysia M. Proko has neither responded to the show cause order, nor brought herself into compliance with Supreme Court Rule 53.1.

Attorney Alysia M. Proko is hereby suspended from the practice of law in New Hampshire. This suspension is in addition to the suspension imposed on March 28, 2013, in ADM-2013-0017, In the Matter of Alysia M. Proko, Esquire, for failure to file her 2012 trust accounting certificate.

Dalianis, C.J., and Hicks, Conboy, Lynn and Bassett, JJ., concurred.

In accordance with Rule 58.2(A) and (C), the Supreme Court appoints retired Marital Master Deborah Rein to the Lawyers Assistance Program (LAP) Commission, to replace Judge John Maher, whose term has expired and who is not eligible for reappointment. Master Rein is appointed to fill a position designated for an active or retired judge. Her term shall commence immediately, and shall expire on March 1, 2015.

The court appoints Attorney Shelley Randall to the LAP Commission, to replace Attorney Heidi Barrett-Kitchen, whose term has expired and who is not eligible for reappointment. Attorney Randall is appointed to fill a position designated for a lawyer. Her term shall commence immediately and shall expire on March 1, 2015.

The court appoints Dr. Sandeep Sobti, MD, to the LAP Commission to replace Nancy Euchner, whose term has expired and who is not eligible for reappointment. Dr. Sobti is appointed to fill a position designated for a health care provider. His term shall commence immediately and shall expire on March 1, 2015.

To assure continuity in the leadership of the LAP Commission, the court reappoints Attorney John Tobin to the LAP Commission, to serve a three-year term commencing on March 1, 2013, and expiring on March 1, 2016. The court waives the provision of Rule 58.2(C), which limits commission members to two consecutive terms, to allow Attorney Tobin to continue to serve on the commission.

The court designates Attorney John Tobin to serve as chair of the commission and Attorney David Wolowitz to serve as vice-chair of the commission.

Supreme Court of New Hampshire


The Supreme Court of New Hampshire hereby gives advance notice of its intention to adopt new Circuit Court – District Division Rules 2.20 to 2.23, relating to the availability of counsel at arraignment, as set forth in Appendix A. Notice of its intention to adopt these rules is being provided to enable attorneys and the Circuit Court – District Division to prepare for implementation.

The court will issue an order in the future formally adopting the rules and establishing a date for the rules to take effect. Prior to issuing such an order, the court will consult with the Administrative Council for the Judicial Branch about when the rules should be made effective, and whether they should be implemented on a pilot basis in a limited number of district division courts or on a statewide basis.

Supreme Court of New Hampshire


Pursuant to Supreme Court Rule 37(4), the Supreme Court reappoints Ms. Patricia Clogher Sherman, FAIA, to the Hearings Committee of the Attorney Discipline System, to serve a three-year term commencing, retrospectively, January 1, 2013, and expiring on December 31, 2015. The Supreme Court also reappoints Attorney Mary Elizabeth Tenn to the Hearings Committee of the Attorney Discipline System, to serve an eight-month term commencing, retrospectively, January 1, 2013, and expiring on July 31, 2013.
