Supreme Court Orders

In accordance with Supreme Court Rule 37(3)(a), the court reappoints Attorney Richard Sager to the Professional Conduct Committee of the Attorney Discipline System, to serve a three-year term commencing January 1, 2014, and expiring December 31, 2016.

The court designates non-attorney Elaine Holden to serve as the non-attorney vice-chair of the committee, effective January 1, 2014.

The Chief Justice, pursuant to RSA 494:1, IX, reappoints Attorney John E. Durkin and Attorney Richard Y. Uchida, to the Judicial Council, to serve three-year terms commencing on January 1, 2014, and expiring on December 31, 2016.

Pursuant to Supreme Court Rule 37(4), the Supreme Court reappoints Attorney Jane M. Schirch, Attorney Peter W. Brown, and non-attorney member Mary Nelson to serve on the Hearings Committee of the Attorney Discipline System, to serve three-year terms commencing on January 1, 2014, and expiring on December 31, 2016.

The court reappoints Attorney Lisah K. Carpenter to serve on the Hearings Committee until April 1, 2014, to enable her to complete a case to which she is assigned.

The court designates Attorney Daniel Will to act as vice-chair of the Hearings Committee, effective January 1, 2014.

Pursuant to Part II, Article 73-a of the New Hampshire Constitution and Supreme Court Rule 51, the Supreme Court of New Hampshire adopts the following amendments to court rules:

I. Depositions in Civil Actions

(This amendment makes the rule governing depositions in civil cases consistent with a recent legislative amendment. RSA 517:4 has been amended, effective January 1, 2014, to permit a party to record a video deposition, provided the party indicates the intent to record the video deposition in the notice provided to the adverse party. See N.H. Laws 2013 ch. 65.)

1. Amend Rule 26(l) of the Rules of the Superior Court of the State of New Hampshire Applicable in Civil Actions, on a temporary basis, as set forth in Appendix A.


II. Character and Fitness Committee

(This amendment adds one additional attorney and one additional non-attorney to the New Hampshire Supreme Court Committee on Character and Fitness.)

1. Amend Supreme Court Rule 42(II)(a), on a temporary basis, as set forth in Appendix B.


III. Foreign Legal Consultants

(These amendments change cross-references in Supreme Court Rule 42D to other Supreme Court Rules.)

1. Amend Supreme Court Rule 42D, on a permanent basis, as set forth in Appendix C.


IV. Superior Court Rules

(On December 16, 2013, the Circuit Court - Family Division will become operational in Cheshire County. Domestic relations cases filed on or after December 16, 2013 will be filed in the Circuit Court - Family Division in Cheshire County and will be governed by the Circuit Court - Family Division Rules. Therefore, this amendment changes the title of the Rules of the Superior Court of the State of New Hampshire Applicable in Criminal Cases Filed in Superior Court and Domestic Relations Cases Filed in the Cheshire County Superior Court to make the rules applicable only in criminal cases.)

1. Amend the title of the Rules of the Superior Court of the State of New Hampshire Applicable in Criminal Cases Filed in Superior Court and Domestic Relations Cases Filed in the Cheshire County Superior Court, on a permanent basis, as set forth in Appendix D.


Effective Date


The amendment set forth in Appendix D shall take effect December 16, 2013. The amendment set forth Appendix C shall take effect January 1, 2014. The temporary amendments set forth in Appendices A and B shall take effect January 1, 2014, and shall be referred to the Advisory Committee on Rules for consideration as to whether they should be adopted on a permanent basis.

The Supreme Court of New Hampshire hereby appoints Attorney Michael T. McCormack to the Board of Bar Examiners, replacing Attorney R. Carl Anderson, whose term has expired and who did not seek reappointment. Attorney McCormack is appointed to serve a three-year term commencing, nunc pro tunc, on November 1, 2013, and expiring on November 1, 2016.
