Having been suspended from the New Hampshire Bar Association for nonpayment of his 2013/2014 bar dues and not having been reinstated within six months of his suspension, Timothy F. Anderson, Esquire, is hereby suspended from the practice of law in New Hampshire in accordance with the provisions of Supreme Court Rule 42A.

This suspension is in addition to the suspension imposed on July 3, 2014, in ADM-2014-0042, In the Matter of Timothy F. Anderson, Esquire, for failure to file his certificate of compliance with the minimum legal education requirements for the reporting year ending June 30, 2013, and to pay the late fees assessed.

In the Matter of A. Adam Prizio, Esquire

On May 2, 2012, Attorney A. Adam Prizio was suspended from the practice of law in New Hampshire for failing to meet minimum continuing legal education requirements for the reporting year ending June 30, 2011. Attorney Prizio has now satisfied the requirements, and the Minimum Continuing Legal Education Committee (MCLE) has filed a motion for his reinstatement. As required by Rule 53, B(2), Attorney Prizio has provided evidence of his continuing competence and learning in the law, and continuing moral character and fitness.

After review of the MCLE Committee’s motion for reinstatement, and the information provided by Attorney Prizio, the court grants the motion for reinstatement. Attorney Prizio is reinstated to the practice of law in New Hampshire, effective immediately.

Pursuant to Supreme Court Rule 37(4), the Supreme Court reappoints Attorney Jamie N. Hage and Attorney Daniel E. Will to the Hearings Committee of the Attorney Discipline System, to serve three-year terms commencing on January 1, 2015 and expiring on December 31, 2017.

In addition, the court designates Attorney Philip H. Utter to serve as chair of the committee, effective January 1, 2015, replacing Attorney James T. Boffetti, whose term has expired. Attorney Daniel E. Will shall continue to serve as vice-chair of the committee.

Committee on Judiciary and Media
The Supreme Court of New Hampshire hereby establishes the New Hampshire Supreme Court Committee on the Judiciary and the Media (Committee). Part I, Article 22, of the New Hampshire Constitution provides: Free speech and liberty of the press are essential to the security of freedom in a state: They ought, therefore, to be inviolably preserved. Consistent with Part I, Article 22, the court creates the committee in order to foster positive communications between the judicial system and the media and to provide a forum for addressing important issues that arise concerning media coverage of judicial proceedings and the judiciary.
Duties of the Committee

The New Hampshire Committee on the Judiciary and the Media will:

1. Encourage a positive relationship between the judicial branch and the media through committee meetings whose membership includes judges from the trial and appellate levels, court clerks, representatives from print and electronic media, court security, representatives from the state bar association and University of New Hampshire School of Law, attorneys specializing in First Amendment law and the judicial branch public information officer;
2. Help to address and resolve, to the extent possible, problems incurred by the media in gaining access to court proceedings or documents;
3. Adopt “media in the court room” policies that respect court proceedings while, at the same time, reduce barriers to the media’s ability to gather and distribute news concerning judicial proceedings and the courts, and
4. Sponsor programs for members of the media with the goal of providing information on how to cover judicial proceedings in New Hampshire and the New Hampshire judicial system.
Membership of the Committee
A. Appointments by the Supreme Court
The New Hampshire Committee on the Judiciary and the Media shall consist of the following members, who shall be appointed by the Supreme Court.
1. One justice of the Supreme Court or designee;
2. One judge of the Superior Court or designee;
3. One judge of the Circuit Court or designee;
4. One clerk of court of a superior court or designee;
5. One clerk of court of a circuit court or designee;
6. The clerk or deputy clerk of the U.S. District Court for the District of New Hampshire or designee;
7. The Attorney General of New Hampshire or designee;
8. The Executive Director of the New Hampshire Public Defender’s Office or designee;
9. The New Hampshire Judicial Branch Public Information Officer;
10. The Manager of Security of the New Hampshire Judicial Branch; and
11. One New Hampshire County Sheriff or designee.

The Supreme Court shall designate a chair of the committee, who shall be a representative of the judiciary appointed pursuant to Section A (1)-(3) above. The chair shall designate a co-chair who shall be a member of the media from the list that follows in Section B.

B. Appointments by the Chair of the Committee

The chair, in consultation with the co-chair, shall have the power to appoint the following additional members of the committee.

1. One member of the Executive Board of the New Hampshire Press Association;
2. One member of the New Hampshire Associated Press Broadcasters Association;
3. One member of the New Hampshire Association of Broadcasters;
4. One member of the New Hampshire Photojournalists Association;
5. Two attorneys specializing in media law; and
6. Up to four “at-large” delegates, which may include a representative of non-traditional media.
Terms
Initial appointments shall be for staggered terms and apply to all members of the committee: one third of the members for three years; one third of the members for two years and one third of the members for one year. Thereafter, the regular term of each member shall be three years. A member selected to fill a vacancy shall hold the office for the unexpired term of his or her predecessor.
Meetings

The Committee shall hold meetings at least twice a year. Additional meetings will be held at the discretion of the co-chairs. All meetings shall be open to the public.
