District Division Small Claims Electronic Filing Pilot Project

Pursuant to Part II, Article 73-a of the New Hampshire Constitution, New Hampshire Supreme Court Rules 51 & 54, and New Hampshire Supreme Court Order dated June 2, 2014, the New Hampshire Circuit Court will begin electronic filing of small claims cases in the 6th Circuit - District Division Franklin, Hillsborough, and Hooksett; the 7th Circuit District Division - Dover and Rochester; and the 8th Circuit Keene and Jaffrey on November 14, 2014.

Small claims actions filed pursuant to RSA 503 in the 6th Circuit - District Division, 7th Circuit District Division, and the 8th Circuit District Division locations shall be filed electronically as of November 14, 2014. A party may be excused from electronic filing only upon a showing of extraordinary circumstances that create a significant hardship to the party that would result in denial of access to the court. Limited exceptions to mandatory electronic filing may be permitted for good cause. See N.H. Cir. Ct.-Dist. Div. Small Claims Electronic Filing Pilot R. 1(b).

Temporary rules for electronic filing have been adopted to facilitate proper electronic filing of small claims actions under RSA 503, see District Division Small Claims Electronic Filing Pilot Rules; Small Claims Actions Pilot Rules to Accompany the Electronic Filing Pilot Rules, along with temporary amendments to the District Division General Rules. See N.H. Sup. Ct. Order (June 2, 2014). These rules and amendments can be accessed electronically at www.courts.state.nh.us.

The temporary rules and amendments shall govern the electronic filing of all documents in newly filed small claims cases commencing on or after November 14, 2014 in the 6th Circuit - District Division, 7th Circuit - District Division, and 8th Circuit - District Division and thereafter shall apply to other circuit court locations as ordered by the Administrative Judge. The temporary rules and amendments pertaining to electronic filing of small claims actions shall apply on a pilot basis only.

New Hampshire e-Court Project Convenience or Service Fees

Pursuant to Part II, Article 73-a of the New Hampshire Constitution, New Hampshire Supreme Court Rules 51 & 54, and New Hampshire Supreme Court Order dated June 2, 2014, the New Hampshire Circuit Court will begin electronic filing of small claims cases in the 6th Circuit - District Division Franklin, Hillsborough, and Hooksett; and in the 7th Circuit District Division - Dover and Rochester; and the 8th Circuit Keene and Jaffrey on November 14, 2014. See generally, RSA 503:3-a (jurisdiction and venue in small claims actions).

Small claims actions filed pursuant to RSA 503 in the 6th Circuit District Division, 7th Circuit District Division, and 8th Circuit - District Division locations are required to be filed electronically as of November 14, 2014. See N.H. Cir. Ct. Admin. Order 2014-46. The District Division Small Claims Electronic Filing Pilot Rules require that a cause of action is not considered initiated and filed until, inter alia, the filing fee, if applicable, has been paid. See N.H. Cir. Ct.- Dist. Div. Small Claims Electronic Filing Pilot R. 6.

Electronic payment of filing fees is subject to a 3% convenience or service fee. This fee is hereby ordered to be treated as other Circuit Court fees pursuant to RSA 503:7 and District Division - Civil Rules 3.23(b) and (c).
