Supreme Court Orders

ADM-2014-0140
In the Matter of Mary Ellen W. Morse, Esquire

The court on December 10, 2015, issued the following order:

On February 4, 2015, Attorney Morse was suspended from the practice of law in New Hampshire for failing to file her 2014 annual trust accounting certificate and failing to pay late fees assessed for late filing of her certificate. Attorney Morse has now filed her 2014 annual trust accounting certificate and paid the late fees assessed. She has requested that she be reinstated to the practice of law in New Hampshire.

Attorney Morse’s request for reinstatement is granted. Attorney Morse is reinstated to the practice of law in New Hampshire effective immediately.

Hicks, Conboy, Lynn, and Bassett, JJ., concurred.

Pursuant to Part II, Article 73-a of the New Hampshire Constitution and Supreme Court Rule 51(A)(7), the Supreme Court of New Hampshire adopts the following amendments to court rules.

I. Strafford and Cheshire County Rules of Criminal Procedure

(On November 23, 2015, the court adopted Strafford and Cheshire County Rules of Criminal Procedure to take effect on January 1, 2016. This order is being issued to make minor corrections to those rules. The rules, as amended by this order, will take effect on January 1, 2016.)

1. Amend Strafford and Cheshire County Rule of Criminal Procedure 2(c), as set forth in Appendix A.

2. Amend Strafford and Cheshire County Rule of Criminal Procedure 4(e), as set forth in Appendix B.

3. Amend Strafford and Cheshire County Rule of Criminal Procedure 5(a), as set forth in Appendix C.

4. Amend Strafford and Cheshire County Rule of Criminal Procedure 5(h), as set forth in Appendix D.

5. Amend Strafford and Cheshire County Rule of Criminal Procedure 10(b), as set forth in Appendix E.

Effective Date

These amendments shall take effect on January 1, 2016.

Pursuant to Supreme Court Rule 37(4), the Supreme Court of New Hampshire appoints Attorneys Alexander M. Lachiatto, Jennifer B. Sargent and George H. Thompson to the Hearings Committee of the Attorney Discipline System, to serve terms commencing January 1, 2016, and expiring on December 31, 2018. In addition, the court appoints Mr. Christopher Hodgdon and Dr. James W. Squires to the Hearings Committee of the Attorney Discipline System, to serve terms commencing January 1, 2016, and expiring on December 31, 2018.

Pursuant to Supreme Court Rule 38-A, the Supreme Court appoints Attorney Heather Krans to the Advisory Committee on Judicial Ethics, to serve the remainder of a term expiring on September 1, 2018. Attorney Krans is appointed to replace Attorney Philip Cross, whose term has expired and who is not eligible for reappointment.

The Supreme Court of New Hampshire appoints Attorney Anna Barbara Hantz and Attorney Janet Hay Subers to the Board of Bar Examiners, to serve three-year terms commencing November 1, 2015, and expiring November 1, 2018. Attorney Hantz and Attorney Subers are appointed to replace Attorney J. Campbell Harvey and Attorney John Harrington, who served on the committee for a number of years and who did not wish to be reappointed.

In the Matter of Eric M. Schroeder, Esquire

Attorney Eric M. Schroeder was admitted to the New Hampshire bar on November 6, 2013. In accordance with Rule 42 XIII, (a), Attorney Schroeder was required to complete the Practical Skills course within two years of admission. The New Hampshire Bar Association reported to the court that Attorney Schroeder did not take the Practical Skills course as required. On November 12, 2015, this court issued an order requiring Attorney Schroeder to show cause why he should not be suspended from the practice of law in New Hampshire for failure to attend a Practical Skills course within two years of the date of his admission to the bar. Attorney Schroeder did not respond to the show cause order.

In accordance with Rule 42, XIII (a), Attorney Schroeder is hereby suspended from the practice of law in New Hampshire. The court hereby requires that Attorney Schroeder’s trust accounts and other financial records be audited at his expense.

Attorney Schroeder is ordered to notify his clients in writing that he has been suspended from the practice of law in New Hampshire and to notify the Attorney Discipline Office by Friday, January 22, 2016, that he has completed this task. On or before Monday, February 1, 2016, the Attorney Discipline Office shall advise the court if it believes that an attorney should be appointed to make an inventory of Attorney Schroeder’s files and to take action to protect the interests of his clients.

On November 19, 2015, this court issued an order, in accordance with Rule 50-A(2), for Attorney Eric M. Schroeder to file his 2015 trust accounting certificate and pay the fines assessed for late filing of the certificate by December 7, 2015, or be suspended from the practice of law in New Hampshire.

Attorney Schroeder has neither responded to the order, nor brought himself into compliance with Supreme Court Rule 50-A(2). Attorney Schroeder is hereby suspended from the practice of law in New Hampshire. This suspension is in addition to the suspension imposed on December 22, 2015, in ADM-2015-0082, In the Matter of Eric M. Schroeder, Esq., for failure to complete the Practical Skills course within two years of admission.

Attorney Bistany has neither responded to the order, nor brought himself into compliance with Supreme Court Rule 50-A(2). Attorney Bistany is hereby suspended from the practice of law in New Hampshire. The court hereby requires that Attorney Bistany’s trust accounts and other financial records be audited at his expense.

Attorney Bistany is ordered to notify his clients in writing that he has been suspended from the practice of law in New Hampshire and to notify the Attorney Discipline Office by Friday, January 22, 2016, that he has completed this task. On or before Monday, February 1, 2016, the Attorney Discipline Office shall advise the court if it believes that an attorney should be appointed to make an inventory of Attorney Bistany’s files and to take action to protect the interests of his clients.

Attorney Hollo is ordered to notify his clients in writing that he has been suspended from the practice of law in New Hampshire and to notify the Attorney Discipline Office by Friday, January 22, 2016, that he has completed this task. On or before Monday, February 1, 2016, the Attorney Discipline Office shall advise the court if it believes that an attorney should be appointed to make an inventory of Attorney Hollo’s files and to take action to protect the interests of his clients.

Attorney Goodwin is ordered to notify his clients in writing that he has been suspended from the practice of law in New Hampshire and to notify the Attorney Discipline Office by Friday, January 22, 2016, that he has completed this task. On or before Monday, February 1, 2016, the Attorney Discipline Office shall advise the court if it believes that an attorney should be appointed to make an inventory of Attorney Goodwin’s files and to take action to protect the interests of his clients.
