In the Matter of Edward M. Van Dorn, Jr., Esquire

On March 1, 2016, this court issued an order suspending Attorney Van Dorn from the practice of law in New Hampshire for failing to file his certificate of compliance with the minimum continuing legal education requirements for the reporting year ending June 30, 2015, and for failing to pay the delinquency fees assessed.

The Minimum Continuing Legal Education Board has advised the court that Attorney Van Dorn has now complied with the minimum continuing legal education requirements for the reporting year ending June 30, 2015, and that he has paid the delinquency fees assessed. Attorney Van Dorn has filed a motion requesting that he be reinstated to the practice of law. Attorney Van Dorn’s request for reinstatement is granted. Attorney Van Dorn is hereby reinstated to the practice of law in New Hampshire.

In accordance with Rule 39(2)(a)(1), the Supreme Court reappoints Superior Court Justice Steven M. Houran to the Committee on Judicial Conduct, to serve a three-year term commencing July 1, 2016, and expiring on July 1, 2019.

In accordance with Rule 39(2)(a)(2), the court appoints Merrimack County Superior Court Clerk Tracy Uhrin to the Committee on Judicial Conduct, to serve a three-year term commencing July 1, 2016, and expiring on July 1, 2019. Ms. Uhrin is appointed to replace Mr. Dana Zucker, whose term is expiring, and who is not eligible for reappointment.

In accordance with Rule 39(2)(a)(5), the court appoints Mr. Edwin (Chip) S. Underhill, IV, to the Committee on Judicial Conduct, to serve a three-year term commencing July 1, 2016, and expiring on July 1, 2019. Mr. Underhill is appointed to replace Mr. Lawrence O’Connell, whose term is expiring, and who is not eligible for reappointment.

In the Matter of Thomas U. Gage, Esquire

On March 15, 2016, the Professional Conduct Committee (PCC) filed a recommendation that Attorney Thomas U. Gage be disbarred. The PCC’s recommendation was based on a stipulation signed by Attorney Gage and Disciplinary Counsel, in which Attorney Gage admitted that he had violated numerous Rules of Professional Conduct and conceded that disbarment was the appropriate sanction for his misconduct.

After the PCC filed its recommendation, an order was issued, in accordance with Supreme Court Rule 37(16), notifying Attorney Gage and Disciplinary Counsel of the PCC’s recommendation and advising them to notify the court of any legal or factual issues relating to the PCC’s recommendation that they wished the court to review. The order stated that if neither party identified an issue to be reviewed, no further hearing would be required, and the court could decide the matter based upon the record of the PCC proceedings. No response to the order has been filed.

In the “Stipulation to Disbarment” filed with the PCC, Attorney Gage admitted that he violated the following Rules of Professional Conduct:

1. Rule 1.15, which requires a lawyer to safeguard the property of clients or third persons in his possession and Supreme Court Rules 50 and 50-A; which establish requirements for lawyer trust accounts;

2. Rule 3.2, which requires a lawyer to make reasonable efforts to expedite litigation consistent with the interests of the client;

3. Rule 3.3, which prohibits a lawyer from making false statements of fact or law to a tribunal;

4. Rule 3.4(c), which prohibits a lawyer from knowingly disobeying an obligation under the rules of a tribunal;

5. Rule 8.4(c), which prohibits a lawyer from engaging in conduct involving deceit, dishonesty, or misrepresentation; and

6. Rule 8.4(a), which prohibits a lawyer from violating the Rules of Professional Conduct.

Attorney Gage also stipulated that an audit of his IOLTA account showed that he misappropriated client funds in his possession, paid himself fees before they were earned, commingled client funds with his own and operated his IOLTA account with a deficit balance or allowed it to be out of trust.

The court has reviewed the “Stipulation for Disbarment” and the PCC’s recommendation that Attorney Gage be disbarred. After considering the nature, seriousness, and extent of Attorney Gage’s misconduct, the court concludes that disbarment is the appropriate sanction in this case.

THEREFORE, the court orders that Thomas U. Gage be disbarred from the practice of law in New Hampshire. He is hereby assessed all expenses incurred by the Professional Conduct Committee in the investigation and prosecution of this matter.

Pursuant to its constitutional authority and powers of general superintendence over the New Hampshire Bar Association and its members, and pursuant to Supreme Court Rule 55, the New Hampshire Supreme Court suspends the assessment to fund the Public Protection Fund (PPF) for the fund year beginning on June 1, 2016, and ending on May 31, 2017.

Pursuant to its constitutional authority and powers of general superintendence over the New Hampshire Bar Association and its members, and pursuant to Supreme Court Rule 58, the court assesses each dues-paying member of the association as of June 1, 2016, as follows, for the purpose of funding the Lawyers Assistance Program (LAP).

The members of the association exempted from the PPF assessment by order dated July 22, 1998, are exempted from the assessment for the LAP. The LAP assessment is due and payable on or before July 1, 2016. If the Board of Governors of the New Hampshire Bar Association grants a member’s request for abatement of bar dues, it may grant a waiver of the assessment.

The New Hampshire Bar Association shall collect the assessment for the account of the LAP and shall report to the court on or before September 15, 2016, the names of those members responsible for the assessment who have not fully paid.

In the Matter of Heather E. Schulze, Esquire

Having been suspended from the New Hampshire Bar Association for nonpayment of her 2015/2016 bar dues and not having been reinstated within six months of her suspension, Attorney Heather E. Schulze is hereby suspended from the practice of law in New Hampshire in accordance with the provisions of Supreme Court Rule 42A.

Attorney Schulze is ordered to notify her clients in writing that she has been suspended from the practice of law in New Hampshire and to notify the Attorney Discipline Office by Monday, June 27, 2016, that she has completed this task. On or before Thursday, July 7, 2016, the Attorney Discipline Office shall advise the court if it believes that an attorney should be appointed to make an inventory of Attorney Heather E. Schulze’s files and to take action to protect the interests of her clients.

Having been suspended from the New Hampshire Bar Association for nonpayment of his 2015/2016 bar dues and not having been reinstated within six months of his suspension, Attorney Charles F. Willson is hereby suspended from the practice of law in New Hampshire in accordance with the provisions of Supreme Court Rule 42A.

Attorney Willson is ordered to notify his clients in writing that he has been suspended from the practice of law in New Hampshire and to notify the Attorney Discipline Office by Monday, June 27, 2016, that he has completed this task. On or before Thursday, July 7, 2016, the Attorney Discipline Office shall advise the court if it believes that an attorney should be appointed to make an inventory of Attorney Willson’s files and to take action to protect the interests of his clients.

Zimmer is hereby suspended from the practice of law in New Hampshire in accordance with the provisions of Supreme Court Rule 42A.

Attorney Zimmer is ordered to notify his clients in writing that he has been suspended from the practice of law in New Hampshire and to notify the Attorney Discipline Office by Monday, June 27, 2016, that he has completed this task. On or before Thursday, July 7, 2016, the Attorney Discipline Office shall advise the court if it believes that an attorney should be appointed to make an inventory of Attorney Zimmer’s files and to take action to protect the interests of his clients.

In the Matter of Michael M. Harrington, Esquire

Having been suspended from the New Hampshire Bar Association for nonpayment of his 2015/2016 bar dues and not having been reinstated within six months of his suspension, Attorney Michael M. Harrington is hereby suspended from the practice of law in New Hampshire in accordance with the provisions of Supreme Court Rule 42A.

This suspension is in addition to the suspension imposed on March 29, 2016, in ADM-2016-0030, In the Matter of Michael M. Harrington, Esquire, for failure to file his certificate of compliance with the minimum legal education requirements for the reporting year ending June 30, 2015, and to pay the late fees assessed.
